The West Virginia attorney general election took place November 6, 2012. The primary took place on May 8, 2012.
Incumbent Darrell McGraw (D) was defeated by Patrick Morrisey (R) in the election for the seat he had held since 1992.
Candidates
Democratic candidate
- Incumbent Darrell McGraw was first elected to the office of AG in 1992.
Republican candidate
- Patrick Morrisey was a health-care attorney who aimed to apply his 20 years of legal experience to an office he described as affected by corruption and outdated leadership practices. He based his campaign on McGraw's handling of the President's health reform law, which he argued should be challenged for "saddling West Virginians with new financial burdens, rising health care costs and unconstitutional mandates." Morrisey aligned with GOP positions in stating: "My position on Obamacare is clear: let's repeal it and start over."[1]
Debates
In mid-February, Morrisey challenged McGraw to a debate tour across all 55 counties of West Virginia. He expressed willingness to work with McGraw on organizing the debates, emphasizing that "the point is that no county will be left behind during this campaign."
In response to Morrisey's repeated requests for debates before the general election, McGraw issued press releases declining, citing his belief that the attorney general’s role as a law enforcement official should remain separate from political activities. He stated, "Any debate would revolve around law enforcement, and I believe law enforcement and politics should not be mixed; I don't think it's good policy to mix law enforcement and politics."[2]
During his 2008 campaign, McGraw faced criticism for declining an invitation from his Republican opponent, Dan Greear, to participate in a public debate.[3]
