Family court marshal dismissed
In February 2014, Judge Gonzalez stated that James Kenyon, one of two court marshals accused of assaulting a woman in family court had been let go.[8] Gonzalez said:
“ | As the judge, I decide who the judicial marshal will be in my department. It is no longer James Kenyon.[8][9] | ” |
Poker star's divorce settlement goes to supreme court; allegations of bias
Judge Gonzalez ruled on the divorce settlement for poker champion Phil Ivey and his ex-wife Luciaetta Ivey in late 2009. Luciaetta Ivey, however, alleged that a campaign contribution to Gonzalez made by her ex-husband had tainted the judge's decision. In 2011, she filed a petition with the Nevada Supreme Court, asking the court to disqualify Gonzalez from the case. The petition claimed, "Luciaetta is entitled to fairness and the appearance of fairness before this court and recusal is the only way that she can be sure to receive both."[10]
Gonzalez, who was appointed in 2009, ran for election in 2010. Phil Ivey donated $5,000 to him in April 2010. The Iveys had been granted a divorce at the end of 2009, but Gonzalez was still presiding over their settlement. Luciaetta Ivey's petition also pointed out that Phil Ivey's divorce attorney, David Chesnoff, as well as the law firm of John Spilotro—who was the first attorney that Ivey had selected to represent his ex-wife—had both donated to Gonzalez's campaign. Gonzalez filed an affidavit stating that he was "capable of rendering judgment in this matter in a fair and just manner."[10]
Chief Judge Jennifer Togliatti denied the first motion to disqualify Gonzalez from the case, so Luciaetta Ivey appealed to the Nevada Supreme Court. However, the high court dismissed the petition on March 28, 2013. The ruling stated: "Without more, the campaign contributions are insufficient to demonstrate that actual or implied bias existed on the part of Judge Gonzalez."[11]
