Ballot title

The ballot title for Question 5 was as follows:

Shall section 4 of article XI of the constitution be amended to remove the requirement that banking laws be passed by the legislature by a two-thirds vote?


Constitutional changes

[Article XI] Section 4. The legislature shall have power to may enact a general banking law for the creation of banks, and for the regulation and supervision of the banking business, provided that the vote of two-thirds of all the members elected to each house, to be taken by yeas and nays, be in favor of the passage of such law.

A simple majority vote is required during two legislative sessions for the Wisconsin State Legislature to place a constitutional amendment on the ballot. That amounts to a minimum of 50 votes in the Wisconsin State Assembly and 17 votes in the Wisconsin State Senate, assuming no vacancies. Amendments do not require the governor's signature to be referred to the ballot.
