Text of measure

Ballot question

The ballot question was as follows:[1]

To maintain and protect essential services such as 9-1-1 emergency medical/fire response; improving wildland fire containment; maintaining 24-hours sheriff’s patrol; attracting/ retaining jobs, businesses, and qualified sheriff deputies; and other essential services, shall the measure to establish a 1 cent sales tax for 10 years in unincorporated Yuba County, providing an estimated $4,300,000 annually requiring accountability, citizens’ oversight/ audits, and all revenue controlled locally, be adopted?[2]

Impartial analysis

The following impartial analysis of the measure was prepared by the office of the Yuba County Counsel:

Approval of Measure K would allow the County of Yuba to impose and collect from the residents and citizens of unincorporated Yuba County a 1% retail sales tax for a period of 10 years for the purpose of providing additional funding for public safety and essential services.

If voters approve Measure K, the County of Yuba would establish and impose upon all retailers in the unincorporated territory of the County a tax at the rate of 1% of the gross receipts, or 1 cent for an item that costs one dollar, on the sale of all tangible personal property sold at retail. This tax would be in addition to any other sales tax currently in effect. If Measure K is approved, the County’s authority to levy this tax will expire 10 years from the Measure’s operative date.

The County estimates that the tax would generate approximately $4,300,000 annually in retail sales tax revenues. The County has expressed its intent to spend these monies on areas of public safety and essential protection services, including 9-1-1 response, wildland fire containment, 24-hour Sheriff’s deputy patrols, and other essential services. All proceeds of the tax would be accounted for and paid into a public safety/essential services trust fund or an account designated for use by the County for such specified purposes.

Measure K also includes provisions for separate accounting and citizen oversight. If approved, Measure K will establish a Citizens’ Oversight Committee to oversee revenues received by the County from the tax and ensure that those revenues are used by the County in a manner consistent with its enacting ordinance.

If approved, the sales tax will become effective immediately following voter approval.

Measure K was placed on the ballot by an adopted resolution of the Board of Supervisors of the County of Yuba.

All voters in the unincorporated territory of the County are voting on Measure K. The Measure may be passed if approved by a majority of the qualified electors in the unincorporated territory of the County voting in Measure K’s favor.

A YES vote on Measure K means the County will enact a transactions and use (“sales”) tax within the unincorporated areas of the County of Yuba of 1% on gross retail sales receipts of tangible personal property for 10 years to use for funding the County’s public safety/essential services needs.

A NO vote on Measure K means the County will not enact a transactions and use (“sales”) tax within the unincorporated areas of the County of Yuba of 1% on gross retail sales receipts of tangible personal property for 10 years to use for funding the County’s public safety/essential services needs.[2]
