City in Maine seeks immunity from wrongful death lawsuit
February 12, 2010
Portland, Maine: The Maine Supreme Court is, as of the time of writing, considering a claim by the Maine city of Portland, on Wednesday, February 10, that says it is immune from the wrongful death lawsuit filed by parents of three high school students killed in a plane crash. The families have filed suit over the deaths of students who were participating in the Lewiston High School's Air Force Junior ROTC program saying that the city is responsible because the employee in charge of the ROTC program was notified that the pilot was operating in an unsafe manner before the incident occurred. The Lewiston attorney successfully argued in a lower court case that the Maine Tort Claims Act makes the city immune and should be made invalid in this case.[1]
