Dismissal of man's petition to reduce sentence has been overturned

Florida: Joseph J. Wilkins, whose petition to reduce his 18 month sentence for the cultivation and possession of cannabis was denied, has been given another opportunity to reduce the sentence. Judge Jonathan D. Ohlman, of the Marion County Circuit Court, had refused Wilkins' request for a hearing saying that the 60 day time frame in which trial judges can modify a sentence had passed despite the motion being file-stamped 53 days after his sentencing. In a decision released Friday, February 12, the 5th District Court of Appeal overturned Ohlman's order and says that Ohlman must now consider a hearing in the case.[1]
