Noteworthy DisputesHere's the latest on noteworthy recounts, lawsuits, and other election disputes. RecountsNew Hampshire: Sixteen state-level recounts begin Nov. 9, 15 of which are state legislative seats. These recounts could affect partisan control of the state legislature. WMUR projects that Republicans are on track to win a 211-187 majority in the state House with control of two seats too close to call and a 14-10 majority in the state Senate. Should Republicans win control of both chambers, they will gain a trifecta in the state. The recounts affect House districts where Republicans gained a net three seats as well as three Senate districts they flipped from Democrats.

Arizona: On Nov. 7, the Trump campaign sued Secretary of State Katie Hobbs (D) and Maricopa County election officials in Maricopa County Superior Court, alleging that ballots with facial irregularities cast in person on Election Day in the county were illegally disqualified without additional review. Facial irregularities include ink splotches, stray markings, and other voter errors that tabulating machines could register as apparent overvotes. Attorneys for the campaign alleged that "numerous voters were alerted ... to a facial irregularity in their ballot – frequently an ostensible 'overvote' – but were induced by poll workers to override the tabulator's rejection of the ballot in the good faith belief that their vote would be duly registered and tabulated." The campaign's lawyers further alleged that "overriding the electronic tabulator's alert automatically disqualifies the putative 'overvotes' without additional review or adjudication," in violation of state law. The campaign asked the court for an order requiring Maricopa County officials to review all such ballots. The campaign also asked the court to bar officials from canvassing or certifying results, pending completion of that review. Pennsylvania: On Nov. 5, the Trump campaign sued the Montgomery County Board of Elections in the Montgomery County Court of Common Pleas, alleging that election officials had counted approximately 600 absentee and mail-in ballots for which voters had not completed the outer declaration envelope, in violation of state law. The campaign first filed its objections with the Montgomery County Board of Elections, which dismissed the challenge. In their complaint, attorneys for the Trump campaign said, "The Montgomery County Board of Elections is not empowered to rewrite the [Pennsylvania] Election Code or adopt rules, regulations, instructions, or decisions that are inconsistent with the Election Code."
Upcoming absentee/mail-in voting deadlinesThirteen states and the District of Columbia have upcoming secondary receipt deadlines for absentee/mail-in ballots. In these states, ballots generally must have been postmarked on or before Election Day, but they will be accepted if they are received within a certain number of days after Nov. 3. These secondary receipt deadlines are listed below in chronological order.
