Idaho's high court rules that schools are not responsible for wrongful conduct of students

The Judicial Update

April 30, 2011

BOISE, Idaho: In a 7-page decision issued on April 20, the Idaho Supreme Court ruled that the Coeur D'Alene School District is not legally liable for the injuries sustained by one sixth-grade student in a fight with another sixth-grader in 2006.[1]

The injured student continues to suffer daily headaches in the wake of the fight, according to testimony in the trial. A lawsuit filed by the student's parents allege that the school district failed to promptly inform them of the fight, and that this delayed medical treatment.[2]

Chief Justice Daniel T. Eismann wrote the Idaho Supreme Court's decision. The decision says that the district is not liable for the wrongful conduct perpetrated by one student upon another. The decision also says that the district is not liable for damages for not promptly informing the parents of the fight and injury because "The only injury the school personnel knew of was Tristen's first injury when he came to the school office. There is no evidence supporting a claim that the School District's failure to provide or secure medical treatment for Tristen in any way exacerbated that injury. Plaintiffs conceded such lack of evidence during oral argument on the motion for {{{{{{{{summary judgment}}}}}}}}."[1]

The decision in the case was unanimous.[2]
