The North Dakota Supreme Court Requirements to Declare Laws Unconstitutional Referendum, also known as Amendment to Section 89, was on the November , 5 1918 ballot in North Dakota as a legislatively referred constitutional amendment, where it was approved.[1] The measure required that four of the five North Dakota Supreme Court justices decide that a law is unconstitutional before it could be declared as such. The court still only required a simple majority to pronounce regular decisions.[2]
