South Carolina: The South Carolina Supreme Court ruled 2-3 to keep the date of the 2012 presidential primary on January 21. The ruling was brought in response to a lawsuit filed by four counties in the state, alleging that county taxpayers would be on the hook for up to $1 million in costs that the state cannot cover. Beaufort, Chester, Greenville and Spartanburg counties brought the suit.

Prior to 2008, political parties ran and paid for their own primary events. In 2007, the South Carolina State Legislature voted to use taxpayer funds to sponsor the 2008 primaries. The counties claim that they were left holding the bag for various unanticipated costs and don't want to see that repeated.

Chief Justice Jean Hoefer Toal wrote the majority opinion and Associate Justice Kaye Hearn authored the dissent.[1]
