Nebraska Revisor of Statutes
The Revisor of Statutes in Nebraska is a state office created by the Nebraska legislature in 1945. The office drafts legislation for the Legislature’s consideration and prepares and publishes replacement volumes of the statutes and supplements. It also reports to the Legislative Council any defects found in state statutes or the Nebraska Constitution and drafts proposed legislation to correct these defects.
With respect to proposed ballot measures--whether the proposed ballot measure would create a new constitutional amendment, a new state statute, or repeal a statute passed by the Nebraska legislature--the Revisor of Statutes is charged with reviewing the proposed wording after it has been submitted by the measure's sponsors to the Nebraska Secretary of State. The Revisor considers the proposed wording, and issues an opinion to the Secretary of State and to the sponsors with recommendations about how to change or revise the wording to make the new legislation fit better with existing law.
A ballot measure sponsor is free to accept or to reject the advice of the Revisor. However, rejecting changes proposed by the Revisor may made a ballot measure more vulnerable to legal challenges down the road.
