Jurisdiction

This court holds the following jurisdiction:[1]

The New York State Court of Claims is the exclusive forum for civil litigation seeking damages against the State of New York or certain other State-related entities such as the New York State Thruway Authority, the City University of New York, the Olympic Regional Development Authority, the Roswell Park Cancer Institute Corporation and the New York State Power Authority (claims for the appropriation of real property only).

The Court of Claims has no jurisdiction over any city, county or town government, or over any individual defendant.[2]

Judges of the New York Court of Claims are each appointed to nine-year terms by the governor with consent from the state senate. They face reappointment at the end of each term. To serve on this court, a judge must be a state resident, at least 18 years old and practice in the state for 10 years. This court has a mandatory retirement age of 70 years old.[3]
