Alabama Eminent Domain, Amendment 5 (1961)

The Alabama Eminent Domain, Amendment 5, also known as Amendment 5, was on the ballot in Alabama on December 5, 1961, as a legislatively referred constitutional amendment. It was defeated. The amendment proposed to amend the constitution. The amendment proposed that those bodies of government authorized to compulsorily acquire property must pay fair market value for properties taken. The said governing body is also liable for any damages or injuries incurred.[1]
