Tolan earned a J.D. from Hamline University.[3]
As of his appointment to the bench in 2017, Tolan was an assistant district attorney for Polk County. His professional experience also includes private work for the county's public defender's office, service as an assistant district attorney for Burnett County and Washburn County, and operating Tolan Legal Services.[3][4]

2017
Wisconsin held local judicial elections in 2017. Forty-eight circuit court seats were up for election on April 4, 2017. Three seats required primaries on February 21, 2017, with the top two vote recipients for each seat advancing to the April 4 general election. Thirty-seven seats up for election in 2017 were unopposed.[7] Incumbent Daniel Tolan defeated Malia Malone in the general election for the Branch 1 seat on the Polk County Circuit Court.
