Building permit for coal power plant vetoed by Arkansas Supreme Court

Arkansas: On Thursday, May 13, the Arkansas Supreme Court affirmed a lower court's decision in reversing a regulatory panel's decision to approve a $1.7 billion coal-fired power plant being built in Hempstead County. The decision was based on a finding that regulators failed to conduct a proper permit hearing because they debated the need for the plant in a separate hearing before holding a meeting on whether to permit it, an act in violation of state law. The Southwestern Electric Power Co. contends that it has conducted separate hearings for its plants for its entire history, however, state law does require that there be a single hearing in order for people to get all the information about the project that they require.[1]
