Idaho Supreme Court suspends attorney's ability to disqualify judges

Idaho: On July 23, 2010, the Idaho Supreme Court Chief Justice, Daniel Eismann, issued an order suspending the use of Section A of Criminal Rule 25. The Rule, as originally written, allowed attorneys to file a request to remove a judge when accompanied by a written statement of the reason for the request, however, in 2008, Eismann signed an amendment to the rule that let attorneys seek disqualification without providing cause. Eismann issued the recent order stating that Section A "has been used excessively and abused so that the use of the rule should be curtailed and a study made of the possible modification or elimination of the rule." Investigations and meeting are expected in order that recommendations be made to the state Supreme Court as to how the rule should be amended or whether it should be dropped.[1]
