Noteworthy events

Dropped DUI charges

In 2011, Judge Gavin was stopped and charged with a misdemeanor DUI after using the shoulder to pass another car. When stopped, police said he smelled of alcohol and failed an eye-gaze test, though the judge refused to participate in other field sobriety tests. Gavin's attorneys said that the judge had not consumed alcohol prior to driving and that the officers might have confused the smell of chewing tobacco. On February 15, Judge Liam C. Brennan dismissed the case, ruling that there was not enough evidence to convict Gavin.[2]
