David K. Frankland is a former judge of the Second Circuit of Illinois. He served in Albion.[1] Frankland retired in December 2016.[2]
Education
Frankland earned a B.A. from Southern Illinois University, going on to receive his J.D. from the University of Missouri. He was admitted to the bar in 1973.[3]
Noteworthy cases
In September 2011 Judge Frankland ruled on the Michael Allison case, in which Allison was charged with multiple felonies for alleged violations of the Illinois eavesdropping act for recording conversations with elected officials and police in regards to a citation he faced and was contesting.
Frankland ruled in favor of Allison, throwing out all charges against him.[4][5] In his ruling, Frankland stated that the Illinois eavesdropping statute is unconstitutional. At the time of the time of the ruling, Allison was contemplating a civil case for wrongful prosecution in order to challenge the state law.[5] Just a few days after the ruling, the Crawford County State's Attorney indicated that the State would likely file an appeal.[6]
