The question on the ballot:[1]

Shall the City update its personnel systems so the Personnel Director will be reclassified as the “Personnel Manager,” who will be hired and supervised by a department head using processes that apply to all classified City employees, through an amendment to City Charter Section 76.1?[2]

Impartial analysis

The following impartial analysis of Measure B was prepared by the office of the city attorney:[1]

This measure, if adopted, would amend Section 76.1 of the Charter of the City of Napa so that the City employee position of Personnel Director would no longer be hired and supervised by the Civil Service Commission. Rather, the title of the Personnel Director would be changed to the “Personnel Manager,” and the Personnel Manager would be hired and supervised by a City department head. This measure was placed on the ballot by the City Council.

Under existing law, the Civil Service Commission (“Commission”) is a five member body, with two members appointed by City Council, two members elected by City employees, and the fifth member appointed by the other four members. The Commission is authorized by the Charter to decide appeals filed by City employees regarding discipline or employment issues, and to provide advisory recommendations for the City Council’s consideration and approval on matters of personnel policy (such as Civil Service Rules for recruiting, hiring, and disciplining employees). Additionally, the Charter currently authorizes the Commission to hire and supervise, and potentially discipline and terminate, one City employee with the title of Personnel Director.

Under existing law, the Personnel Director generally administers the City’s personnel systems, as set forth in the Charter and the Civil Service Rules, including the administration of employee recruitments, examinations, promotions, and hiring. The Personnel Director is the custodian of personnel records, and attends all Commission meetings.

This measure, if adopted, would change the title of the Personnel Director position to “Personnel Manager.” However, the responsibilities of the Personnel Manager under the Charter as amended by Measure “B” would be the same as the current responsibilities of the Personnel Director, and the Personnel Manager would retain civil service protections of employment provided to all classified employees (including the Personnel Director). Under civil service protections, the Personnel Manager could only be disciplined or terminated for cause, and the Personnel Manager could appeal any such discipline or termination to the Commission. The fundamental change proposed by Measure “B” is that the Commission would no longer have the authority to hire and supervise the Personnel Director; rather, the Personnel Manager would be hired and supervised by a City department head (currently the Human Resources Director) using the civil service procedures that apply to all other classified employees of the City.[2]
