An effort to recall Hall County Commissioner Craig Lutz was judicially invalidated in October 2011.[1] The recall effort was initiated by a group of citizens in August 2011.
Background
Supporters of the recall argued that Lutz violated Georgia's open meetings law and illegally fired the county's top three administrators.[2] Kevin Kanieski and Bobby Husley were leaders in the recall effort.[1]
Path to the ballot
On August 18, a group of Hall County citizens submitted 229 signatures to the Hall County Elections Office. Proponents of a recall election are required to submit at least 100 valid signatures. The elections office verified that the names of those who signed the petition were registered voters.
On August 23, Lutz asked a judge to review the recall application. After Hall County Superior Court Judge Andrew Fuller recused himself from the matter, Gwinnett County Superior Court Judge Tom Davis took the case. The judicial review temporarily suspended all recall efforts.[3]
On October 7th, a Gwinett County judge sided with Lutz, throwing out the recall petition and ruling that the recall organizers did not have sufficient grounds for a recall.[1]
