An effort to recall Larry Wilson from his position as an elected treasurer of Shawnee County, Kansas was launched in December 2011[1] and abandoned in March 2012 after recall organizers failed to submit sufficient signatures.[2] Wilson's term expires in November 2013, and he has announced that he does not plan to seek re-election.[3]
Recall supporters
Doug Roudybush, Jim Marchello and Sue Jirkovsky-Lander were all members of a citizen's committee seeking Wilson's recall. The recall petition alleged that Wilson commingled funds from motor vehicle and real estate taxes, failed to reconcile accounts, and didn't developed written procedures for the emergency exit for his staff.[1] Wilson testified before the Shawnee County Commission that he used motor vehicle money to pay salaries of employees who work in the real estate tax division of his office.[4] Wilson, a Democrat, has been asked to resign by his own party.[1]
Topeka City Councilman Andrew Gray and local radio hosts Raubin Pierce and Megan Mosack supported the recall effort.[3]
DA clears Wilson
In April 2012, after the recall effort had failed, Shawnee County District Attorney Chad Taylor said the results of a seven-month investigation by his office did not lead to evidence of malfeasance on Wilson's part. Taylor wrote, "after a thorough investigation conducted with the assistance of the office of the attorney general, I have concluded that Treasurer Wilson may not have complied with a strict construction of the law under two limited circumstances. However, these two grounds do not approach the level of malfeasance required to institute an ouster proceeding."[5]
Path to the ballot
Recall organizers turned in their petition for certification on December 9th, 2011.[3] District Attorney Chad Taylor had five days to decide whether the petition meets all legal requirements to be certified. The petition was certified on December 13th. Recall organizers then had 90 days to gather 31,395 signatures, giving them a deadline of March 12th, 2012 for signature submission.[3] Recall organizers did not submit sufficient signatures in time to meet the deadline.[2]
