The ballot title for Proposal No. 5 was as follows:
| “ | PROPOSAL NO. 5 PROPOSED AMENDMENT TO PERMIT THE ELECTION OF MEMBERS OF THE LEGISLATURE DURING THEIR TERM OF OFFICE TO ANOTHER STATE OFFICE. Section 9 of Article IV of the State Constitution now prohibits the election as well as the appointment of members of the Legislature during their term of office to another state office. SHALL THIS SECTION BE AMENDED TO PERMIT THEIR ELECTION TO ANOTHER OFFICE? YES NO | ” |

A two-thirds vote is required during one legislative session for the Michigan State Legislature to place a constitutional amendment on the ballot. That amounts to a minimum of 74 votes in the Michigan House of Representatives and 26 votes in the Michigan State Senate, assuming no vacancies. Amendments do not require the governor's signature to be referred to the ballot.
