NM Supreme Court asks retired judges to return to bench to help with caseload

TAOS, New Mexico: The New Mexico Supreme Court is resorting to more extreme measures in order to address increasing docket loads with less funding and judges. They recently asked former judges Joseph Caldwell and Peggy Nelson to temporarily return to the bench in Colfax County until the end of June to help assist in the increased caseloads faced by current judge John M. Paternoster. The increased case load comes on the heals of an investigation into judge Sam B. Sánchez, who in 2009 held some 30 members of the public in contempt of court. Sánchez has taken over the civil case load only to prevent a conflict of interest involving cases with prosecutors who are currently investigating. Caldwell and Nelson will be paid for their services and will work until Governor Susana Martinez appoints a third judge for the district this summer.[1]
