The measure would have made the [[Attorney General of South Dakota|attorney general's]] salary the same as the other state officers enumerated in Article 4, Section 12 of the [[South Dakota Constitution]]. This included the [[South Dakota Secretary of State|secretary of state]], [[South Dakota State Auditor|auditor]], [[South Dakota Treasurer|treasurer]], superintendent of public instruction and [[South Dakota Commissioner of School and Public Lands|commissioner of school and public lands]]. The measure was known as House Joint Resolution 3 in the [[South Dakota Legislature]]. Shall the above amendment to the constitution in relation to the salary of the Attorney General be approved and ratified.

A simple majority vote is required during one legislative session for the South Dakota State Legislature to place a constitutional amendment on the ballot. That amounts to a minimum of 36 votes in the South Dakota House of Representatives and 18 votes in the South Dakota State Senate, assuming no vacancies. Amendments do not require the governor's signature to be referred to the ballot.
