Georgia court throws out police officer's conviction

Georgia: The Georgia Supreme Court upheld a lower court's decision that to throw out a former police chief's conviction for claiming simultaneous work hours in two separate police department. Leonard Smith was a chief for Unadilla Police Department and had allegedly claimed hours for his home department, as well as, the Fort Valley police department when he was convicted by Dooly County Superior Court in 2007. This ruling was reversed in March of 2009 by the Georgia Court of Appeals saying that the "prosecution was required to notify Smith of when the proposed indictment would be presented to the grand jury."[1]
