The Maryland Special Election for Vacancy in State Legislature Amendment was not on the ballot in Maryland as a legislatively referred constitutional amendment on November 3, 2020.[1]

The amendment would have required that vacancies in the state legislature that occur 21 days prior to the state filing deadline for general statewide elections be filled by a special election.[2]

To put a legislatively referred constitutional amendment before voters, a supermajority vote of 60 percent is required in both the Maryland State Senate and the Maryland House of Representatives in one legislative session.

This amendment was introduced as Senate Bill 10 on September 6, 2019. On January 29, 2020, the state Senate passed SB 10 in a vote of 44-0, with one abstaining and one excused. Those abstaining or excused were Democrats. SB 10 did not receive a vote by the state House prior to the legislature's adjournment on March 18, 2020.[1]
