Ballot question

The ballot question was as follows:[1]

Shall the proposed ordinance adding a Specific Plan Overlay and amending the Solana Beach Municipal Code (SBMC) to allow a state-licensed residential care facility of up to 99 beds for those in need of assisted living in the ER-2 (Estate Residential-2) Zone at 959 Genevieve Street be adopted?[2]

The following impartial analysis of the measure was prepared by the office of the Solana Beach City Attorney:

This measure would add a specific plan overlay and amend the Solana Beach Municipal Code (SBMC) to allow a state-licensed residential care facility of up to 99 beds for those in need of assisted living in the Estate Residential-2 (ER-2) zone on the 2.91-acre property adjacent to northbound Interstate 5 at 959 Genevieve Street ("Plan").

Currently, the ER-2 zone is designated as intended for residential development in areas characterized by single-family homes on semirural estate lots of one-half acre or larger. This measure would add a "Solana Beach Senior Care Specific Plan" allowing a "Residential Care Facility for the Elderly" ("RCFE") licensed by the State of California with assisted living and memory acommodations, for those requiring long term support with daily living requirements. While the Plan's title includes "Senior," the measure does not include any age restrictions for residents. State law allows persons under 60 years of age with compatible needs to be admitted to a RCFE facility.

The measure establishes development standards increasing the maximum floor area ratio to .55 and maintaining current minimum lot dimensions. It increases population density to approximately 34 persons/acre for a 99-bed facility. Maximum building heights would remain at 25 feet with allowances for elevator overruns, elevator and stair access areas to exceed the the height limit and an elimination of the existing daylight plane requirements. Building setbacks would be 10 feet on the residential and freeway sides, 40 feet in the rear, 200 feet from Marine View Ave and 25 feet from Genevieve Street. Open Space would be allowed along Marine View Ave in front of a parking lot. Space requirements include 85 sf of sleeping area and 40 cubic feet of storage area per bed, 1 full bathroom per 3 beds, common living area of 500 sf plus 50 sf per bed. The Plan contains landscaping and architectural design requirements, right-of-way improvements and adjustments, and off street parking of 1 space per employee and 1 space per 7 beds.

As proposed, a RCFE would have to go through the normal City of Solana Beach Structural Development Permit, Development Review Permit, CEQA and California Coastal Permit processes, but the requirement for a Conditional Use Permit would be eliminated and replaced Plan's standards. The measure requires the City to amend its General Plan, certified Land Use Plan and Zoning Ordinances where the Plan creates inconsistencies. The measure was placed on the ballot by a petition signed by the requisite number of voters. Proposition T, approved in 2000, requires a public vote on the Plan.

If the measure passes, it can only be changed, amended, or repealed by a vote of the people.

Voting "yes" favors allowing a state-licensed residential care facility of up to 99 beds at 959 Genevieve. A "no" vote is against the Plan and would leave in effect existing City ordinances for ER-2.[2]

The following official argument was submitted in favor of the measure:[1]

YES on Measure B means that you support the approval of a Specific Plan that establishes of rules, guidelines and processes that will only apply to a state licensed Residential Care Facility for the Elderly (RCFE) at 959 Genevieve St. If the Measure wins, the proposed RCFE must still go through the standard City design review process including approval by the City Council and the California Coastal Commission at noticed, public hearings, and a State of California RCFE licensing approval.

Solana Beach needs more residential care facilities. Research shows that a well-managed residential care facility allows seniors to live longer, happier and healthier lives. Our local population is aging and SANDAG projects the elderly will double over the next 15 years. The City has a shortage of senior care options and this Measure enables residents and others to age in our community instead of having to look elsewhere.

959 Genevieve Street is the right location. The site is near shopping, recreational activities, and medical offices. At 2.91 acres, the site is also one of the few vacant properties in Solana Beach that is large enough to accomodate a facility of the size and quality the City needs and demands.

The Specific Plan establishes standards for 959 Genevieve street to ensure quality design features and a building that blends with the neighborhood character. Examples include height limits, increased setbacks, larger sleeping and common living areas and more open space and landscaping than the City otherwise requires.

City laws require voter approval of the Measure. Your YES vote will help to allow more senior housing options in Solana Beach.

Official argument

The following official argument was submitted in opposition to the measure:[1]

The Solana Beach Municipal Code should not be amended to allow a 90+ bed assisted living facility to be developed at Genevieve Street and Marine View Avenue. The surrounding neighborhood can’t safely accommodate the increased traffic the facility would generate. Development would create severe safety risks for residents of the community, students at the nearby LePort Montessori school, and residents of the facility.

The rural roads in this secluded residential neighborhood are extremely narrow, with no sidewalks or street lights. Pedestrians and drivers must navigate dangerous intersections that are visually obstructed by steep hills and sharp turns. The facility would exponentially increase traffic from staff, visitors, and emergency and delivery vehicles.

  • There would be no effective evacuation route during an emergency such as a fire. Marine View is much narrower than a typical two-lane road. Cars traveling in opposite directions along Marine View must veer to the side of the road to allow safe passage for pedestrians and other cars. Large vehicles such as delivery and recycling trucks completely block passage, limiting emergency access.
  • Increased traffic would endanger students of the LePort Montessori school located at the intersection of Marine View and Solana Drive. A steep hill and sharp turn at the intersection make it difficult to see other drivers and pedestrians. Large vehicles traveling to and from the facility would exacerbate these safety concerns.
  • Ambulance and other emergency vehicles would need to slowly navigate the narrow, winding roads to the facility. Time is very costly to anyone having a heart attack or stroke. 911 service is required for assisted living residents suffering from common issues such falls, chest pain, or difficulty breathing.

This isn’t the right place for large-scale development. Please vote no to protect the safety of everyone in this residential community.

This measure was put on the ballot through a successful initiative petition campaign. The development company RhodesMoore LLC led the effort to gather 1,250 signatures to send the initiative before the city council. City officials verified that at least 900 of the signatures were valid, meeting the minimum requirement. The Solana Beach City Council voted unanimously on January 30, 2019, to send Measure B to the special election ballot on May 7, 2019.[4]
