The ballot title for State Oil and Gas Board and Regulations Referendum was as follows:
“ | AN ACT Entitled, An Act to Conserve Crude Petroleum Oil and Natural Gas; to Create a State Oil and Gas Board and to Define Its Powers and Duties; to Authorize Such board to Promulgate Rules and Regulations for the Enforcement of the Provisions of the Act and to Conserve Oil and Gas; to Provide Penalties for Violation of Certain Provisions of the Act or the Regulations Promulgated Thereunder; to Repeal Sections 42.0601, 42.0602, 42.0603, 42.0604, 42.0605, 42.0606, 42.9906 and 42.9907 of the South Dakota Code of 1939; and to Repeal all Other Laws, and Parts of Laws, in Conflict with this Act. | ” |
Path to the ballot
A veto referendum is a citizen-initiated ballot measure that asks voters whether to uphold or repeal an enacted law. This type of ballot measure is also called statute referendum, popular referendum, people's veto, or citizen's veto. There are 23 states that allow citizens to initiate veto referendums.
In South Dakota, the number of signatures required for a veto referendum is equal to 5% of the votes cast in the last gubernatorial election. Signatures for veto referendums are due 90 days following the final adjournment of the legislative session at which the targeted bill was passed. A simple majority vote is required for voter approval.
