The ballot title for Unemployment Compensation Commission Referendum was as follows:
| “ | AN ACT Entitled, An Act to Repeal Section 10 of Chapter III of the Special Session of the Legislature of the State of South Dakota for the year 1936; to Amend Subsection (c) of Section 19 Thereof; to Amend Subsections (c) (d) (f) (h) and (i) of Section 6 Thereof, and Subsection (g) of Section 11 Thereof; to Repeal Subsection (e) of Section 6 Thereof; to Abolish the Unemployment Compensation Commission of South Dakota; to Create the Office of Unemployment Compensation Commissioner of South Dakota to Administer the "Unemployment Compensation Law," and Define His Duties; and to Transfer the Functions and Duties of the Director of State Employment Service to the Unemployment Compensation Commissioner. | ” |
Path to the ballot
A veto referendum is a citizen-initiated ballot measure that asks voters whether to uphold or repeal an enacted law. This type of ballot measure is also called statute referendum, popular referendum, people's veto, or citizen's veto. There are 23 states that allow citizens to initiate veto referendums.
In South Dakota, the number of signatures required for a veto referendum is equal to 5% of the votes cast in the last gubernatorial election. Signatures for veto referendums are due 90 days following the final adjournment of the legislative session at which the targeted bill was passed. A simple majority vote is required for voter approval.
