James Howard Barrett is the magistrate judge for the 7th Judicial District in Idaho, primarily serving Bingham and Custer counties. He was appointed by the district's magistrate commission on July 2, 2015, to succeed Judge Charles L. Roos, whose retirement took effect on August 31, 2015.[1][2]

As a newly appointed judge, Barrett will serve an 18-month probation period. He will then have to run for retention election at the next following general election in November 2018, if he wishes to remain in office.[2]

Biography

Barrett was born in Madison County. He earned a B.A. from Idaho State University in 1991. From 1994 to 1998, he was an English teacher and adjunct professor at Ricks College. In 2000, he earned a J.D. from the Idaho College of Law. Two years later, he completed an L.L.M. at the University of Denver. After being admitted to the Idaho State Bar Association, he started a criminal law practice. From 2003 to 2007, he was a prosecutor for the cities of Bingham, Fremont, and Rexburg. He became a Bonneville County public defender in July 2007 and was appointed chief public defender for the county in 2008. He served in that roll until his appointment to the court.[2]

Judges of the Idaho Magistrate Division are appointed by a district magistrate commission. Magistrates occupy the bench for 18 months after their initial appointment, after which they must run in the next general election if they wish to continue serving.[3]

Qualifications
To serve on this court, a judge must:[3]

  • have earned a high school degree or its equivalent;
  • be at least 30 years old;
  • be licensed to practice law in the state; and
  • have practiced law for at least five years.
