Judge Boone announces indefinite leave of absence

Hagerstown, Maryland: W. Kennedy Boone, III announced on April 19, 2011 that he is taking an indefinite leave of absence from his position on the Maryland Fourth Circuit Court in Washington County, where he has served since 1997. "I’ve got some family problems. My wife has some health issues, and I have my own problems,” he explained.

Judge Boone had been under scrutiny since pleading guilty last year to driving under the influence in 2009. He was subjected to probation, including regular Breathalyzer tests, and was fined $1,000. The judge said that the leave of absence was not due to any violation of his probation or disciplinary agreement, though the Commission on Judicial Disabilities did contact him on April 11th regarding allegations that he had been drinking again. The judge did point to stress as a factor for his leave.

Judge Boone is required to retire in 2012 when he turns 70, although he may choose to retire early. While he is away from the court, retired Judge Frederick C. Wright III will hear cases in his place.
