Nicole Cannon is a former magistrate court judge for the Idaho Magistrate Division District Five serving Twin Falls County.[1] Cannon was sworn into office on March 11, 2011, becoming the second woman to be appointed to the 5th Judicial District bench in the court's history and the first woman in over 40 years.[2] She resigned from the court in June 2012, following a citation for driving under the influence.[3]

Prior to her work as a judge, Cannon worked in the Minidoka County Prosecutor’s Office for 11 years. [2]

In April 2012, Cannon was cited for driving under the influence. The charge was assigned to the Fourth Judicial District, where Cannon initially pleaded not guilty.[4] Court records showed that Cannon's blood-alcohol content tests were 0.221 and 0.239, nearly three times the legal limit to drive. Cannon tried unsuccessfully to have the tests thrown out, arguing that they were administered improperly.[5]

In December 2012, Cannon pleaded guilty and was sentenced to 160 hours of community service, which was converted from 20 days in jail. Along with community service came a sentence of one year of misdemeanor supervised probation, a 90-day suspended driver's license, a fine of $1,278.50 and an order to complete 16 hours of alcohol/DUI education classes and attend a victims panel.[6]
