On January 15, 2010 Killpack was pulled over by a Utah Highway Patrol Trooper for driving erratically. The trooper smelled "a strong odor of alcohol," and had Killpack perform sobriety tests. Killpack was arrested when he refused to take a breath test, spending about two hours in jail. The next day Killpack announced that he would resign his office effective immediately.
He stated, "My heart weighs heavy. I have a tremendous amount of respect for the legislative process, my legislative colleagues and for my constituents. At this time the Legislature would be a distraction from what is most important and, frankly, I find that I have become a distraction to the Legislature."[1]
