Judge grants injunction in airport tax issue

On April 7, 2003, Judge Moore requested a new excise tax the Wayne County Airport Authority proposed to levy against off-site parking and shuttle owners at Detroit Metropolitan Airport be ruled illegal. According to the Dearborn Press & Guide, "On Feb. 10, the Wayne County Airport Authority announced it would soon begin charging off-site airport transportation providers (including area hotels, limousines, shuttle buses and taxis) for access to facilities at Metro Airport for the purpose of passenger pick-up and drop-off. The parking facilities maintain that, as they are each already assessed a 30 percent tax by the State Airport Parking Tax for each customer transaction, these new charges constitute an additional state tax. The imposition of an additional tax without due process is illegal says the suit — violating the Michigan Open Meetings Act, case law, constitutional due process, the Headlee Amendment of the Michigan Constitution and equal protection of the law."[5]
