The following impartial analysis of the measure was prepared by the office of the Dunsmuir City Attorney:

If this Measure is adopted by a majority of the voters, the position of City Clerk would be appointive, not elective. Presently the position of City Clerk is an elected position. Government Code section 36508 permits the City Council to submit to the electors the question of whether the City Clerk should be appointed by the City Council. The City Council has placed this Measure on the ballot to provide an opportunity to the voters to decide whether the City Clerk of the City of Dunsmuir should be an appointed position. The majority of California cities have appointed city clerks. This Measure will have no impact on the incumbent City Clerk, as the position is presently vacant and the term of office expires in November. Presently, the City Council may appoint a person to fill the vacancy. The person appointed serves the remainder of the term of the City Clerk. An elected City Clerk must be a resident and voter of the City. An appointed City Clerk is not required to be an elector of the city. The appointed City Clerk serves at the pleasure of the City Council. If Measure D passes, the City Council would have the ability to assign the duties of City Clerk to a City employee who could perform the function as additional duties. [2] |
