Moon v. Terrell County et al. was a case before the Georgia Court of Appeals in 2001 concerning open meetings laws.

Background

Moon v. Terrell County et al. , 249 Ga.App. 567 (2001) (Barnes, J.): Court of Appeals held that, even though defendant employer asked plaintiff whether he would prefer a closed or open session to discuss his employment status and he chose a closed session, the Act states that “the public at all times shall be afforded access to meetings declared open to the public.” One citizen cannot elect to close a meeting that should be open. Defendant's action of terminating plaintiff's employment was void, as it was accomplished in violation of Act.[1]
