Ballot question

The following question appeared on the ballot:[1]

Shall Ordinance No. 227 amending portions of Chapter 3.30.030 of the Point Arena Municipal Code to increase the City of Point Arena's existing Transient Occupany Tax (a bed tax paid when overnight visitors rent a room) from ten percent (10%) to twelve percent (12%) to fund public services and maintain public areas, effective April 1, 2017, which proposed rate increase and amendment is anticipated to raise an additional $17,000 per year in revenue and which will continue until repealed by the City Council or the city voters, be adopted?[2]

Impartial analysis

The following impartial analysis of the measure was prepared by the office of the Point Arena City Attorney:

Cities and counties may tax persons staying thirty (30) days or less in hotels, motels, and similar lodgings. The tax is imposed on the hotel guest; the hotel has the duty to collect and transmit the funds to the taxing agency. The Point Arena City Council has placed Measure AC on the November 8, 2016 ballot to ask the voters of the City of Point Arena to increase the City of Point Arena’s existing Transient Occupancy Tax from ten percent (10%) to twelve percent (12%). Any additional income from this increase will be used to fund public services and maintain public areas. The measure will amend the Point Arena Municipal Code and become effective April 1, 2017. While there is no way to calculate the additional funds that will be raised, the City anticipates the increase and amendment will raise an additional $17,000 per year.

All cities in the County of Mendocino, and the County, have transient occupancy taxes. The transient occupancy tax is a general tax and must be placed on the ballot and approved by a majority of the City electorate voting in the election.

Transient occupancy taxes are general taxes, and authorized by law for use to provide basic City services. The Point Arena City Council has placed an Advisory Measure “AD” on the ballot which seeks approval of using any funds generated by the additional 2% of the Transient Occupancy Tax in the following manner: (1) Onequarter of the revenues to substantially increase promotions and marketing for Point Arena; (2) one quarter of the revenues to support events such as the Independence Day Celebration and Harbor Festival; (3) one quarter of the revenues to fund maintenance and improvements to the Arena Pier and City Property at the Cove; and (4) one quarter of the revenue for Park and Parking Improvements in the downtown area that support tourism and benefit the community.

A YES vote approves Measure AC and will increase to 12% the City’s Transient Occupancy Tax.

A NO vote rejects Measure AC and The City’s Transient Occupancy Tax remains at 10%.

A YES vote approved Advisory Measure AD and directs the City to use the funds generated by the increased Transient Occupancy Tax as stated.

A NO vote rejects Advisory Measure AD and therefore no direction is given to the City as to how additional funds generated by the increased Transient Occupancy Tax are to be used.[2]
