October 13, 2023: In September, President Biden issued two executive orders, bringing his total to 123 executive orders since taking office in January of 2021, and bringing his average executive order count to 45 per year.

The presidential executive order allows the President of the U.S. to create a declaration that has the force of law without it having to pass through Congress first. While the exact number of executive orders that have been signed in U.S. history is unknown, estimates place the number somewhere around 16,200 orders since 1789. In the 1920's and 1930's, presidential executive orders averaged at over 200 per year, peaking under President FDR, who passed an average of 307 executive orders per year during his presidency. President Biden’s annual average of 45 executive orders per year is lower than presidents Clinton (46 per year), Reagan (48 per year), and Trump (55 per year), but exceeds those of presidents Obama (35 per year), Bush (36 per year), and H.W. Bush (42 per year).[1][2]
