Jurisdiction

This court holds the following jurisdiction:[1]

Sixty-seven judges preside. There are 54 magistrate courts. These are courts of limited jurisdiction. Jury trials.

This court will hear these types of cases: Tort, contract, landlord/tenant rights ($0-10,000); Felony preliminary hearings; Misdemeanor, DWI/DUI and other traffic violations.[2]

Judges of the New Mexico Magistrate Courts are each elected to four-year terms.[3] The elections for this court are partisan contested elections. To serve on this court, a judge must be a qualified elector of the district and have a high school diploma or equivalent. In districts with a population greater than 200,000 people, a judge must also be licensed to practice law in New Mexico.[4]

New Mexico is one of seven states that use partisan elections to initially select judges and then use retention elections to determine whether judges should remain on the bench. To read more about how states use judicial elections to select judges across the country, click here.

Retention election

In these elections, judges do not compete against another candidate, but voters are given a "yes" or "no" choice whether to keep the judge in office for another term. The retention elections are held on general election day. In a retention election, a candidate must receive 57% of the vote to be retained.[5]
