The Florida Marijuana Legalization Initiative (Initiative #25-01) may appear on the ballot in Florida as an initiated constitutional amendment on November 3, 2026.
Measure design
The initiative would legalize marijuana for use by adults 21 and older; prohibit smoking or vaping marijuana in public spaces; prohibits packaging or marketing that appeal to children; and provide for licensing for non-medical marijuana businesses.[1]

Path to the ballot
Process in Florida
An initiated constitutional amendment is a citizen-initiated ballot measure that amends a state's constitution. Eighteen (18) states allow citizens to initiate constitutional amendments.
In Florida, the number of signatures required for an initiated constitutional amendment is equal to 8% of the votes cast in the last presidential election. Proponents must obtain signatures equaling at least 8% of the district-wide vote in the most recent presidential election in at least half (14) of the state's 27 congressional districts. A 60% vote is required for voter approval. In 2006, voters passed an amendment for the 60% vote requirement. The requirements to get an initiative certified for the 2026 ballot:
- Signatures: 880,062 valid signatures is required.
- Deadline: The deadline for signature verification is February 1, 2026. Officials have 30 days to check signatures.
Details about the initiative
The following is the timeline of the initiative:
- January 14, 2025: The ballot initiative was approved for signature gathering.[1]
- June 2, 2025: Officials verified that the campaign had collected 377,831 valid signatures, surpassing the 25% threshold (220,016) required to trigger legal and fiscal review.[1][3]
- July 8, 2025: Officials verified that the campaign had collected 613,206 valid signatures.[4]
- August 21, 2025: Smart & Safe Florida was granted a preliminary injunction against a law passed in 2025 in Florida that changes requirements for signature gatherers. U.S. District Judge Mark Walker ruled that the law infringed on petitioners' First Amendment rights.[5]
