The Hawaii Protection of Water Resources, Amendment 22, also known as Amendment 22, was on the ballot in Hawaii on November 7, 1978, as a convention referred constitutional amendment. It was approved. The amendment proposed one new addition to the constitution: Article XI, Section 7. The amendment stated that the state has the obligation to protect, control and regulate the use of Hawaii’s water resources for the benefit of the people; the legislature would create a water resources agency, who would monitor conservation and quality, and develop policies. The agency would define beneficial and reasonable uses, protect ground and surface water, watersheds, natural stream environments, establish criteria of water use priorities while assuring appurtenant rights and existing correlative and riparian uses, and establish procedures for regulating all uses of Hawaii’s water resources.[1]
