The North Carolina Department of Education Amendment was not put on the 2016 presidential primary ballot in North Carolina as a legislatively referred constitutional amendment. The measure, upon voter approval, would have replaced the State Board of Education and the elected Superintendent of Public Instruction with a Department of Education and a head appointed by the governor.[1]

Ballot title

The proposed ballot title was:[1]

[ ] AGAINST

Constitutional amendment providing for a more efficient system of management of public education by providing for a Department of Education, which shall be headed by a person appointed by the Governor subject to confirmation by the General Assembly, and by abolishing the State Board of Education and the Superintendent of Public Instruction.[2]

A 60 percent majority vote in both chambers of the General Assembly of North Carolina was required to refer this amendment to the ballot. North Carolina is one of nine states that require a 60 percent majority.
