Noteworthy events
Arrest for money laundering, embezzlement charges
Silva was arrested at San Francisco International Airport on March 5, 2017, on felony money laundering, grand theft, and embezzlement charges. He pleaded not guilty to these charges in San Joaquin County Superior Court on March 6, 2017, with a second hearing held on March 13, 2017. The charges stem from a county investigation of financial decisions made during Silva's time at the Boys & Girls Club of Stockton.[5] A court appearance scheduled for October 23, 2017, was delayed by the court to December 11, 2017.[6]
Silva's arrest in Amador County
On August 11, 2017, Silva pleaded no contest to a charge of providing alcohol to a minor as part of a plea deal to drop three other charges and avoid jail time. The plea deal led to one year of probation and 40 hours of community service for Silva.[7]
On August 4, 2016, Silva was arrested and charged on four criminal counts including recording confidential information, contributing to the delinquency of a minor, and providing alcohol to a minor. He was arrested at the Silver Lake Family Camp in Amador County that he oversees each summer but was released after posting $20,000 bail on the same day.[8][9] On October 18, 2016, the charges against Silva were reduced from felonies to misdemeanors by an Amador County judge with a hearing scheduled for December 2, 2016.[10] Silva rejected an offer to settle his case and his first hearing was moved to January 5, 2017.[11] A second hearing by phone took place on March 7, 2017.[12]
The Amador County District Attorney's Office filed criminal charges against Silva based on information supplied by the FBI. The charges stemmed from an investigation started by the FBI in September 2015 after Silva's phone was confiscated at San Francisco International Airport. The FBI discovered audio recordings from August 7, 2015, indicating Silva played strip poker and supplied alcohol to youth counselors including a 16-year old counselor. The district attorney's filing with the Amador County Superior Court also concluded that these recordings were illegal because of a lack of consent by participants.[13]
Silva attorney Mark Reichel told The Sacramento Bee that investigators possessed the information for 11 months and the timing was suspicious given Silva's re-election bid. The Stockton Police Officers Association called for Silva's resignation, stating in a Facebook post that "the Mayor’s actions have formed not merely a dark cloud, but a full-fledged storm, over the Mayor’s ability to govern and represent the City of Stockton."[13] Councilman Daniel Wright also responded to the arrest by calling for the mayor's resignation, saying "We cannot let today’s incident hinder Stockton’s progress."[13]
Mayor's stolen gun used in violent crime
Silva faced scrutiny over his decision to delay reporting the theft of two guns from his house, one of which was used in the murder of Rayshawn Harris on February 22, 2015. The San Joaquin County District Attorney's Office reported on July 29, 2016, that Silva did not report the theft of the gun used in the murder until March 22, 2015. Silva's guns were stolen in separate thefts in 2014 and 2015 with the second gun not recovered by police as of August 1, 2016.[14]
