Executive Order 13258: Amending Executive Order 12866 on Regulatory Planning and Review was a presidential executive order issued by President George W. Bush (R) in 2002 that adjusted existing regulatory planning and review procedures. E.O. 13258 amended President Bill Clinton's (D) Executive Order 12866 by removing the role of the vice president from its regulatory planning and review procedures. Bush's order also made several changes to the group of presidential regulatory policy advisers listed in E.O. 12866. In 2009, President Barack Obama (D) revoked E.O. 13258 and another of Bush's regulatory executive orders when he issued Executive Order 13497.[1][2][3]
Background
President George W. Bush (R) issued Executive Order 13258, titled "Amending Executive Order 12866 on Regulatory Planning and Review," on February 26, 2002. It made technical changes to the language of President Bill Clinton's (D) Executive Order 12866, which established principles and processes to govern federal agency rulemaking, regulatory planning, and regulatory review. In 2007, Bush made additional, more substantive changes to Clinton's order when he issued Executive Order 13422. Both of Bush's orders were revoked in 2009 by his successor, President Barack Obama (D), under Executive Order 13497.[1][2][3]
Provisions
E.O. 13258 had 14 sections adjusting the language of E.O. 12866. Most of the sections removed the vice president's role from various regulatory planning and review procedures. In some sections, the vice president was replaced with the director of the Office of Management and Budget or the White House chief of staff.[1]
Section 3 of E.O. 13258 made the following changes to E.O. 12866's list of presidential regulatory policy advisers:[1]
- Replaced the assistant to the president for science and technology with the director of the White House Office of Science and Technology Policy
- Replaced the assistant to the president for intergovernmental affairs with the deputy assistant to the president and director for intergovernmental affairs
- Replaced the deputy assistant to the president and director of the White House Office of Environmental Policy with the chairman of the Council on Environmental Quality and director of the Office of Environmental Quality
- Added the assistant to the president for homeland security

Barack Obama
In 2009, President Barack Obama (D) revoked E.O. 13258 and another of Bush's regulatory executive orders by issuing Executive Order 13497, titled "Revocation Of Certain Executive Orders Concerning Regulatory Planning And Review." Obama's executive order did not state a reason for revoking E.O. 13258 or Bush's other order.[2]
