An effort to recall Menominee City Council member Joe Dulak is underway in Menominee, Michigan.[1]

Recall supporters

Recall organizer Joseph Fournier filed a petition citing Dulak’s failure to recuse himself from votes on marijuana-related ordinances, despite his role as a business owner and the potential for personal financial gain from related property sales, as the reason for the recall.[1]

Recall opponents

Speaking to the Eagle Herald, Dulak said, “I respect the court and the judicial process, but I strongly disagree with this decision. The petition is riddled with factual and clarity issues, and under Michigan law even one defect should invalidate it. It’s also unfortunate that the petition sponsor has chosen to pursue such an unfounded and malicious effort, but I remain confident the Court of Appeals will correct this clear legal error.”[1]

No specific grounds are required for recall in Michigan. To get a recall on the ballot in Michigan, recall supporters must collect signatures equal in number to 25% of voters in the jurisdiction in the last gubernatorial election. They have 60 days between the collection of the first signature and the collection of the last signature on the petition. Recall petitions are eligible to collect signatures for 180 days.[2][3][4]
