Executive Order 14075: Advancing Equality for Lesbian, Gay, Bisexual, Transgender, Queer, and Intersex Individuals was a presidential executive order issued by President Joe Biden (D) in June 2022 that aimed to "combat unlawful discrimination and eliminate disparities that harm LGBTQI+ individuals and their families," including the development of educational "policies for supporting LGBTQI+ students' well-being and academic success," according to the text.[1]
Background
President Joe Biden (D) issued Executive Order 14075, titled "Advancing Equality for Lesbian, Gay, Bisexual, Transgender, Queer, and Intersex Individuals," on June 15, 2022. The order put forth a series of health and education initiatives in order to "combat unlawful discrimination and eliminate disparities that harm LGBTQI+ individuals and their families," according to text. Among the initiatives, E.O. 14075 directed the secretary of education to develop policies aimed at supporting the academic success of LGBTQI+ students.[1]
Provisions
Policy
Section 1 of E.O. 14075 stated the policy of the executive order was to equip the federal government to "ensure that every person—regardless of who they are or whom they love—has the opportunity to live freely and with dignity." To address what the order refers to as systemic discrimination and barriers, Executive Order 14075 sought to address discrimination and barriers faced by LGBTQI+ individuals, including providing educational support for LGBTQI+ students.[1]
Addressing harmful and discriminatory legislative acts
Section 2 of E.O. 14075 directed the secretary of the Department of Health and Human Services (HHS) "to protect LGBTQI+ individuals' access to medically necessary care from harmful State and local laws and practices."[1]
Addressing conversion therapy
Section 3 of E.O. 14075 directed the secretary of HHS to "establish an initiative to reduce the risk of youth exposure to so-called conversion therapy."[1]
Section 3 encouraged the Federal Trade Commission to "consider whether so-called conversion therapy constitutes an unfair or deceptive act or practice, and to issue such consumer warnings or notices as may be appropriate."[1]
The order further directed the secretary of state to collaborate with the secretary of the treasury, the HHS secretary, and the administrator of the United States Agency for International Development to develop an action plan to promote an end to the use of conversion therapy around the world.[1]
Promoting family counseling and support
Section 4 of E.O. 14075 directed the secretary of HHS to expand family counseling and support programs for LGBTQI+ youth in federally funded health, human services, and child welfare programs.[1]
Addressing discrimination and barriers
Section 5 of E.O. 14075 directed the secretary of HHS to consider how to use the department's authority "to strengthen non-discrimination protections on the basis of sex, including sexual orientation, gender identity, and sex characteristics, in its programs and services." It directed the secretary of HHS to work with the assistant secretary for family support to establish an initiative aimed at eliminating disparities in the child welfare system experienced by LGBTQI+ children.
Reviewing eligibility standards for federal benefits
Section 6 of E.O. 14075 directed the HHS secretary, within 180 days of the date of E.O. 14075, to conduct a study on federal regulatory standards and the ability of LGBTQI+ households to access federal family benefits; directed HHS to produce a public report with findings and recommendations aimed at increasing LGBTQI+ households' participation in federal family benefits; and required the director of the Office of Management and Budget to coordinate with departments and agencies that administer programs to establish eligibility standards for LGBTQI+ families.[1]
Safeguarding access to health services
Section 7 of E.O. 14075 directed the secretary of HHS to establish an initiative aimed at addressing health disparities for LGBTQI+ children and adults.[1]
Supporting LGBTQI+ students
Section 8 of E.O. 14075 directed the secretary of education to establish a working group on LGBTQI+ students and families, to lead an initiative aimed at addressing discrimination against LGBTQI+ students, and to provide support for LGBTQI+ students and families.[1]
Strengthening support for LGBTQI+ adults
Section 10 of E.O. 14075 directed the secretary of HHS to "address discrimination, social isolation, and health disparities faced by LGBTQI+ older adults."[1]
Promoting inclusive federal data collection practices
Section 11 of E.O. 14075 stated, "Advancing equity and full inclusion for LGBTQI+ individuals requires that the Federal Government use evidence and data to measure and address the disparities that LGBTQI+ individuals, families, and households face, while safeguarding privacy, security, and civil rights." The order directed the co-chairs of the Interagency Working Group on Equitable Data established in Executive Order 13985 to establish a subcommittee to coordinate with agencies on the federal government's collection of data aimed at supporting LGBTQI+ individuals.[1]
