Reactions to nomination

On the nomination:

Staci Yandle is an excellent candidate for the federal bench in Southern Illinois. She will bring a wealth of knowledge and litigation experience to the position. I am pleased that President Obama has nominated her today. I will be working with Senator Kirk to see her nomination approved by the Senate.

See also: United States District Court for the Southern District of Illinois (United States of America v. Iyman Faris, Case 17-CV-295-SMY-DGW)

On July 11, 2018, Judge Staci Michele Yandle denied a motion made by the federal government seeking to revoke the citizenship of Iyman Faris, a naturalized citizen who, in 2003, was sentenced to 20 years in prison after pleading guilty to providing material support for terrorism in connection with a 2003 plot to the cut the cables on New York City's Brooklyn Bridge. Faris became a naturalized citizen in 1999. Attorneys for the federal government argued that Faris was not lawfully admitted to the United States as a permanent resident, thereby nullifying his claim to naturalized citizenship. Faris admitted to first entering the United States in 1994 using a passport and visa belonging to someone else. This, attorneys for the government argued, constituted willful misrepresentation on Faris' part, which would be grounds for denaturalization under federal law. Yandle rejected this argument: "The Government argues that Faris' admission, that he utilized another person's passport to enter the United States, alone establishes that he was inadmissible under 8 U.S.C. § 1182(a)(6)(C)(i). However, there is nothing in the record currently before the Court that establishes as a matter of law what effect, if any, Faris' alleged misrepresentations had on the decision to grant him citizenship." Yandle's order was not a definitive resolution to the suit, which was expected to proceed to the fact-finding and trial phases.[7][8]
