Rulemaking, in the context of administrative law, is a process that enables federal agencies to amend, repeal, or create an administrative regulation. The most common rulemaking process is informal rulemaking, which solicits written public feedback on proposed rules during a comment period. When required by statute, certain agencies must follow the formal rulemaking process, which incorporates a trial-like hearing in place of the informal comment period, or hybrid rulemaking, which blends specified elements of formal rulemaking into the informal rulemaking process.[1]
Background
The rulemaking process was established under the Administrative Procedure Act (APA), enacted in 1946. The specific procedures that federal agencies must follow as part of the rulemaking process are outlined in U.S. Code § 553 for informal rulemaking and U.S. Code § 556 and § 557 for formal rulemaking.[1]
Informal vs. formal rulemaking

Most federal agencies use the informal rulemaking process to develop, modify, or repeal administrative rules. According to the APA, formal rulemaking occurs "when rules are required by statute to be made on the record after opportunity for an agency hearing." Generally, formal rulemaking is only required in specific circumstances, such as certain administrative rules pertaining to ratemaking or food additives.[1][2]
The primary difference between formal and informal rulemaking lies in the methods used to solicit and consider public feedback on a proposed rule. Formal rulemaking requires the consideration of a proposed rule during a trial-like hearing process in which interested parties provide testimony and evidence before a presiding officer, whose decision is generally drafted into a final rule. Informal rulemaking, on the other hand, establishes a comment period for members of the public to submit written feedback on a proposed rule, which the agency takes into consideration when drafting a final rule.[1][3]
Hybrid rulemaking

Hybrid rulemaking occurs when Congress mandates that an agency follow certain rulemaking procedures in addition to the informal rulemaking process. Hybrid rulemaking blends specified elements of formal rulemaking into the informal rulemaking process to create a non-standard rulemaking method for use in certain circumstances. For example, Congress may require an agency to create a formal record, hold hearings, allow for oral testimony, or cite detailed fact findings or conclusions from the record. According to the Congressional Research Service, hybrid rulemaking generally results in greater public participation than informal rulemaking while remaining less rigid than formal rulemaking.[1][4][5]
Procedure
The majority of the formal rulemaking process mirrors the informal rulemaking process, which the Office of Information and Regulatory Affairs (OIRA) breaks down into nine steps. The difference occurs in step six, which calls for a hearing during formal rulemaking and a comment period during informal rulemaking. Hybrid rulemaking procedures vary depending on the statute, but generally blend specified elements of formal rulemaking into the informal rulemaking process.[3]

Negotiated rulemaking

Negotiated rulemaking is a supplementary rulemaking tool that allows federal agencies and stakeholders to build consensus on a proposed rule prior to beginning the informal rulemaking process. During negotiated rulemaking, an advisory committee made up of affected parties, at least one agency official, and one or more neutral mediators, known as "convenors," meet to negotiate a consensus on a proposed rule. Negotiated rulemaking is generally used at the discretion of the agency with the goal of improving communication between agencies and stakeholders, avoiding litigation, and increasing efficiency in the rulemaking process.[6]

Publication rulemaking is a rulemaking procedure that allows federal agencies to bypass the informal rulemaking process and directly implement certain rules through publication in the Federal Register. These rules, such as general agency policies, interpretive rules, and procedural rules, do not carry the force of law and cannot create or modify regulations. Instead, rules promulgated through publication rulemaking serve to provide guidance or clarification regarding the application of existing rules.[7][8]

Federal rule requires drug advertisements to explicitly state prices (2019)
A final rule published May 10, 2019, by the Centers for Medicare & Medicaid Services (CMS), an agency within the Department of Health & Human Services (HHS), requires pharmaceutical companies to include the list price, also known as the wholesale acquisition cost, of certain prescription drugs in television advertisements. The requirement applies to medicine covered by Medicare or Medicaid.[9]
According to the summary of the final rule published in the Federal Register, the rule is intended to make Medicare and Medicaid administration more efficient by giving beneficiaries of the programs more information about the costs of drugs.[9] CMS argues that the new rule will use public scrutiny to pressure manufacturers into lowering drug prices and will equip patients to make more informed healthcare decisions.[9]
Under the rule, television advertisements for prescription drugs will be required to state the cost for a 30-day supply.[9] The disclosure will not be necessary for drugs with a cost of $35 or less.[9]
Health & Human Services Secretary Alex Azar said in a press release that “Requiring the inclusion of drugs’ list prices in TV ads is the single most significant step any administration has taken toward a simple commitment: American patients deserve to know the prices of the healthcare they receive.”[10] He added, “Making those prices more transparent is a significant step in President Trump’s efforts to reform our prescription drug markets and put patients in charge of their own healthcare.”[10]
Several public comments submitted to CMS before it finalized the rule argued that the proposal went beyond the agency’s authority under the Social Security Act.[9] The commenters said that the provisions of the Social Security Act being interpreted by CMS in the final rule are general housekeeping measures and “not broad delegations of authority.”[9] Public comments also addressed whether the rule violated free speech provisions of the First Amendment and whether the wholesale acquisition cost, which doesn’t include discounts or rebates, was the appropriate price to be disclosed.[9]
The final rule was scheduled to go into effect on July 9, 2019, but federal judge Amit Priyavadan Mehta from the United States District Court for the District of Columbia blocked the rule in a decision on July 8 following a lawsuit brought by three pharmaceutical companies and the Association of National Advertisers.[9][11] The plaintiffs argued that Congress did not grant the HHS authority to regulate drug advertising and that the rule amounted to compelled speech in violation of the First Amendment.[11] Judge Mehta ruled that HHS exceeded its authority under the Social Security Act to adopt the new rule and said "plain statutory text simply does not support the notion—at least not in a way that is textually self-evident—that Congress intended for the Secretary to possess the far-reaching power to regulate the marketing of prescription drugs."[11]
After Mehta's decision, a White House spokesperson told The New York Times, “It is outrageous that an Obama appointed judge sided with big PhRMA to keep high drug prices secret from the American people, leaving patients and families as the real victims.”[12]
