Seven County Infrastructure Coalition v. Eagle County, Colorado is a case that was decided by the Supreme Court of the United States on May 29, 2025, during the court's October 2024-2025 term. It concerned whether agencies are required to assess environmental impacts beyond the scope of their regulatory authority. The case was argued on December 10, 2024.
In a 8-0 opinion, the court reversed and remanded the judgment of the United States Court of Appeals for the District of Columbia Circuit, holding that the D. C. Circuit failed to afford the U. S. Circuit incorrectly interpreted NEPA to require the board to consider the environmental effects of upstream and downstream projects that are separate in time or place from the Uinta Basin Railway. Justice Brett Kavanaugh delivered the opinion of the court. Justice Neil Gorsuch took no part in the consideration or decision of the case.[1]

The Seven County Infrastructure Coalition petitioned the Surface Transportation Board (STB) in 2020 to begin construction of a new rail line in Utah, in which the “predominant and expected primary purpose would be the transport of waxy crude oil produced in the Uinta Basin.” The board was required to complete an environmental impact statement pursuant to the National Environmental Policy Act (NEPA) highlighting the environmental impacts associated with the new rail line before granting approval.[3]
Eagle County, Colorado, and a group of environmental organizations challenged the board’s decision to approve the construction of the rail line, arguing that the STB did not complete an adequate environmental review as directed by NEPA. They argued that the board should have considered the environmental impacts of the proposed rail line extracting crude oil.
The United States Court of Appeals for the District of Columbia Circuit ruled in favor of the group, arguing that the STB “cannot avoid its responsibility under NEPA to identify and describe the environmental effects of increased oil drilling and refining on the ground that it lacks authority to prevent, control, or mitigate those developments.”[3]
The decision was appealed to the U.S. Supreme Court which agreed to hear the case during the October 2024-2025 term.[4]

In deciding cases involving the American economy, courts should strive, where possible, for clarity and predictability. Some courts’ NEPA decisions have fallen short of that objective. The proper judicial approach for NEPA cases is straightforward: Courts should review an agency’s EIS to check that it addresses the environmental effects of the project at hand. The EIS need not address the effects of separate projects. In conducting that review, courts should afford substantial deference to the agency as to the scope and contents of the EIS. Plaintiffs’ policy objections to this 88-mile Utah railroad may or may not be persuasive. But neither “the language nor the history of NEPA suggests that it was intended to give citizens a general opportunity to air their policy objections to proposed federal actions. The political process, and not NEPA, provides the appropriate forum in which to air policy disagreements.” Metropolitan Edison, 460 U. S., at 777. Citizens may not enlist the federal courts, “under the guise of judicial review” of agency compliance with NEPA, to delay or block agency projects based on the environmental effects of other projects separate from the project at hand.
