The Minnesota Equal Under the Law Amendment may appear on the ballot in Minnesota as a legislatively referred constitutional amendment on November 5, 2024, or November 3, 2026.[1]
The constitutional amendment would add language to the constitution to prohibit the denial of rights to individuals based on race, color, creed, sex, sexual orientation, gender identity or expression, age, disability, ancestry, or national origin. An amendment to the bill by the state House of Representatives included a right to make decisions about all matters relating to one's own pregnancy or decision whether to become or remain pregnant and move the vote on the amendment to the 2026 general election.[2]

To put a legislatively referred constitutional amendment before voters, a simple majority vote is required in both the Minnesota State Senate and the Minnesota House of Representatives.
This amendment was introduced as Senate File 37 on January 5, 2023. On May 17, 2023, the state Senate passed SF 37 in a vote of 43-23.[1]
